RECENT PRODUCT RECALLS DUE TO SAFETY CONCERNS

Recalls can be scary. But, knowing what products are recalled is a way to make sure you keep you and your family safe. Below are some recent recalls:

FISHER-PRICE ROCK ‘N PLAY SLEEPER:

Fisher-Price issued another recall of its Rock ‘n Play Sleepers. Four years ago, Fisher-Price issued a recall of the same products after numerous infant deaths were reported. The same recall was recently extended after additional reports of infant deaths. The fatalities occurred after infants rolled from their backs to their stomachs or sides while in the sleepers. The sleepers are sold at all Walmart and Target stores nationwide, as well as on Amazon. Consumers are advised to stop using the sleepers immediately. Since the original recall in April 2019, almost five million sleepers have been sold.

NISSAN VEHICLES:

Nissan is recalling approximately 400,000 vehicles after discovering a defect in the airbag function. The airbag systems are overly vulnerable to wear and tear. This can cause the airbags to detach and the Nissan badge on the steering wheel, and other component parts, to detach and become projectiles. Several injuries have been reported as a result of the airbag defect. The recall affects the following vehicle models: Nissan Frontier, Nissan Titan, Nissan Xterra, Nissan Pathfinder, Nissan Armada, and Nissan Quest. STARBUCKS FRAPPUCCINO:

The FDA recently issued a recall of bottled Vanilla Starbucks Frappuccino manufactured by PepsiCo, Inc. and sold under the Starbucks brand name. The bottled  drinks are sold at grocery stores across the country. The FDA’s Class II recall was initiated after it was discovered there may be shards of glass in the bottles. Approximately 300,000 bottles are included in the recall and have expiration dates between March 2023 and June 2023.

PARADISE GRILLS OUTDOOR KITCHENS:

Approximately 18,000 First Generation Outdoor Kitchens manufactured by Paradise Grills are recalled due to safety concerns. The manufacturer announced the recall after two consumers reported being severely burned after their kitchens exploded. Since then, Paradise Grills determined that liquid propane gas can accumulate in the kitchen cabinets and cause an explosion when the grill is reignited. The recalled kitchens were sold throughout the south.

REGULATION OF PFAS IN JUVENILE PRODUCTS

Polyfluoroalkyl and perfluoroalkyl substances, referred to as PFAS and “forever chemicals,” are highly toxic. The chemicals are known to increase the risk of numerous injuries including immune system suppression and certain cancers. Notably, they do not break down in the human body or the environment.

WHY DO BABY AND CHILDREN’S PRODUCTS CONTAIN PFAS?

PFAS are widely used because they are stain-resistant, waterproof, and grease-resistant. These properties make them ideal for use in baby and children’s products. PFAS are prevalent in countless baby and children’s products including bassinets, booster seats, toys and clothing.

WHY ARE PFAS IN BABY AND CHILDREN’S CLOTHING BAD?

Recent studies show the levels of PFAS in children’s products are extremely elevated. One study in 2022 found PFAS in children’s uniforms. Another study found children’s products labeled as eco-friendly or non-toxic actually contain PFAS.

Most recently, a recent study focused on baby supplies shows high levels of PFAS in a broad range of baby products including clothing, bedding, playmats, snack bags, and toys. The results are especially disturbing because babies and children are very susceptible to the effects of harmful chemicals.

ARE PFAS IN BABY AND CHILDREN’S PRODUCTS REGULATED BY THE GOVERNMENT?

Although the federal government started determining how to regulate PFAS in the environment and some consumer products, there are no federal guidelines limiting the amount of PFAS in children’s clothing and products. Fortunately, states have begun to take matters into their own hands and regulate PFAS. Luckily, the few states that are doing so are enacting stringent and immediate regulations.

For example, California prohibits manufacturers of “juvenile products” from selling any new products containing PFAS after July 1, 2023. The list of juvenile products is exhaustive and includes baby pillows, sleepers, car seats, highchairs, toys, and mattresses. Legislation further mandates that PFAS chemicals must be replaced with the least toxic alternatives.

In Colorado, manufacturers of juvenile products sold after January 1, 2024, are prohibited from selling products with “intentionally added” PFAS chemicals. Intentionally added means chemicals are added during the manufacturing process to give products a specific characteristic such as waterproof or stain-resistant.

Other states such as New York, Maine, and Oregon require manufacturers using PFAS in children’s products to notify the appropriate state health or environmental authority. Even more states including Georgia, Minnesota, and Rhode Island have proposed bills to regulate PFAS in baby and children’s products.

Hopefully, this is the beginning of a trend and all states will follow suit. Ideally, the federal government will take note and strictly regulate PFAS in baby and children’s products.

LOUISIANA DRAM SHOP LAWSUITS

The FDA oversees the regulation and safety of drugs, medical devices, many food items, and cosmetic products. While some products, such as life-saving medical devices, are strictly regulated, the regulation of cosmetic products is notoriously permissive.

But in December 2022, the Modernization of Cosmetics Regulation Act of 2022 (“MoCRA”) was enacted, and becomes effective on December 29, 2023. MoCRA is the first update to the FDA’s cosmetic regulations since 1938, and makes the FDA’s regulatory framework for cosmetics more stringent. The goal of the act is to increase consumer safety and ingredient transparency.

CAN YOU SUE A BAR FOR OVERSERVING CUSTOMERS?

The answer is different from state to state. The relevant laws are called “dram shop” laws. In Louisiana, bars (or social hosts) are not responsible for overserving people over the age of 21 who leave and hurt or kill themselves or someone else. But if the bar serves alcohol to a minor (under 21) and that person leaves the bar and hurts or kills themselves or someone else, you can sue the bar.

DRAM SHOP LAW

Dram shop laws apply to bars, taverns, or other businesses (or social hosts) that serve alcohol. If a bar overserves a customer, the customer leaves and causes harm, then the owner of the bar is responsible. Each state has its own policy. With few exceptions, Louisiana does not have dram shop laws. Louisiana law protects dram shops and their owners from liability.

LOUISIANA’S ANTI-DRAM SHOP LAW.

The anti-dramshop law is La. R.S. 9:2800.1. It limits liability for loss connected with selling, serving, or supplying alcohol to others. The law takes power from the people (jury), by declaring that in every situation, the cause of any injury, including death and property damage inflicted by an intoxicated person upon himself or someone else is caused by the consumption of alcohol, rather than providing alcohol to the drunk person. It essentially removes all responsibility from the supplier of alcohol. But Louisiana’s anti-dramshop law has exceptions.

LIABILITY FOR SERVING UNDERAGE GUESTS.

It only limits liability for providing alcohol to “a person over the age for the lawful purchase thereof.” This means if the bar provides alcohol to someone who is not old enough to legally buy it, then the bar may be responsible if the underage customer leaves and gets hurt, killed, or causes injuries or someone else to be killed.

LIABILITY FOR SERVING GUESTS WHO ARE HURT ON THE PREMISES.

The law also specifically applies to injuries or death “suffered off the premises.” That means normal premises liability laws apply to the dram shop, and a jury could find that serving alcohol to a customer of any age contributed to his injuries or death.

LIABILITY FOR TRICKING SOMEONE INTO DRINKING ALCOHOL.

It does not limit liability if the provider of alcohol forces someone else to drink alcohol, or falsely represents that the drink does not contain alcohol.
